STATE REGULATORY INFORMATION

Under the laws of the State, through provisions of Act 148 of 1943, and as amended in 1949, 1967, and 1983, and Administrative Rules 390.561 to 390.569, Michigan provides for the regulation and licensing of private schools, trade schools, business schools, and institutions in the State of Michigan. All private trade schools, business schools, and institutions operated by any person, firm, or corporation for the purpose of teaching any trade, occupation, or vocation shall secure a license from the State Board of Education.

The license may be revoked at any time, if in the judgment of the Board, the person, firm, or corporation is not complying with the provisions of the law, or the rulings and directives of the Board. Before such license may be issued, the applicant must have operated under a temporary permit in a manner satisfactory to the State Board of Education. The school's personnel, its standards of operation, instructional practices and methods, and content of advertising must satisfactorily meet the requirements of the State Board of Education.

The State Board of Education is required to make provisions for adequate inspection of all private trade schools, business schools, and institutions. Such schools are required to submit reports to the Board and to make available to authorized representatives of the Board all records pertaining to the school and to the individual enrollee.

Private trade schools, business schools, or institutions shall provide the State Board with evidence of surety to provide indemnification to any student suffering loss because of inability to complete a course or program of study due to the closing of the school.

The permit for operation will be issued to a school for a specified period by the State Board for a twelve-month period. The permit expires on the date specified unless the date is extended in writing by the Department, in which case it shall expire on the date written on the extension. The operation of a school under a permit will be evaluated by authorized department personnel for conformance with the laws. After such an evaluation of a school, and it shows conformance with the laws for the previous twelve months, a license will be issued.

The law also requires that an annual fee be paid for each new or annual license or permit issued.

It is essential that the owners of the school have a satisfactory record of integrity and business practice. The financial cash records, assets, liabilities, and capital shall be available for inspection by authorized departmental personnel. Students' records including payment of fees, programs, awards, and placement records for at least two years following graduation shall be available. Tuition rates and other costs on the students shall be furnished to the State Board of Education. Classroom loads shall also be available to the Department.

Courses of instruction shall extend over a sufficient period to meet current standards of trade and business practices; adequate space and material shall meet local and State health and sanitation requirements.

It should also be pointed out that the standard set forth by the State in the rules apply to home study schools in so far as possible.
